Thank you for inquiring about our office assisting you with a Chapter 13 Bankruptcy. Chapter 13 Bankruptcy places all of your debt together in a simple payment plan. Known as "debt consolidation", Chapter 13 Bankruptcy consolidates debts into a manageable payment plan which allows you to pay back the debts with a single payment each month to the Bankruptcy Trustee. When you arrive at our office, you will meet with an attorney, contrary to what happens at most bankruptcy offices. Your case will be prepared by an attorney, not a paralegal. Also, you will not be asked to wait hours to see the attorney while you fill out forms as in other offices. The attorney fees for a Chapter 13 Debt Reorganization are established by court order and are based upon recommendation of the United States Trustee. Attorney fees are paid out of your Reorganization Plan payment to the Court, not by you directly to my office. Usually, the only fee you need for commencement of a Chapter 13 is the court filing fee. If you own, or are purchasing real property that you reside in, it is necessary that a Declaration of Homestead be filed with the County Recorder before the filing of your case with the United States Bankruptcy Court. There is an additional charge for my office to prepare and file this document with the County Recorder. If you already have a Declaration of Homestead filed with the County Recorder, please provide a copy of it at the time of your appointment with my office.
